Reputed Staten Island gang member accused in box-cutter attack, month after release from prison

STATEN ISLAND, N.Y. -- A reputed gang member is accused of using a box cutter to slash a man’s face and neck during a mugging in Stapleton last week, just one month after his release from prison for an earlier robbery.
Police say John Pena, 19, of Warren Street — who authorities say is a member of the "Gorilla Stone Mafia" — and another suspect attacked their victim at about 4:20 a.m. Tuesday, outside of 180 Canal St.
The duo first asked the man for a cigarette, then Pena’s accomplice started punching him in the face, and knocked him to the ground, police allege.
"Give us your cell phone," Pena commanded, and tried to grab the phone from his hands, court papers allege.
When the victim stood up, Pena retaliated with a box-cutter, according to court papers.
The blade caused "deep lacerations" on his face and neck that required 35 medical staples to close, court papers allege.
Police caught up with Pena on Friday. He’s charged with first- and third-degree assault, first-, second- and third-degree attempted robbery, and third- and fourth-degree criminal possession of a weapon, said Peter N. Spencer, a spokesman for District Attorney Daniel Donovan.
Back in November 2008, Pena was arrested on allegations he and three other teens pistol-whipped and robbed a livery car driver two months earlier, according to Advance records.
Pena pleaded guilty to second-degree attempted robbery in 2009 and was sentenced to a determinate sentence of three years in state prison, followed by two years of post-release supervision. He was conditionally released on June 22, public records show.
A conditional release is required under state law after an inmate completes six-sevenths of a sentence with no major infractions on his or her record.
Pena is being held on $100,000 bail until his next appearance in Stapleton Criminal Court on Thursday.
